From the amended complaint in this action the following facts are made to appear: Early in 1922 this plaintiff, Henry Schlueter, and many other persons associated with them, by their joint efforts and investments acquired the right to explore certain tracts of land in Rosebud county for oil and gas. They also acquired a large amount of personal property consisting of drilling machinery and equipment, and proceeded to sink a well upon the leased land. They had sunk it to a depth of about 3,500 feet, and it was their intention to proceed with the work until commercial production was secured, or…
