Pending before the court are plaintiff Britvic Soft Drinks Ltd.’s Motion for Partial Summary Judgment (Doc. 88) and Mo tion for Summary Judgment on Defendant’s Counterclaims (Doc. 90). As set forth below, plaintiffs Motion for Partial Summary Judgment is denied and plaintiffs Motion for Summary Judgment on Defendant’s Counterclaims is granted.
