This is an action to recover damages for tbe death of the plaintiff’s intestate, alleged to have been caused by the negligent operation of the defendant’s truck. When the plaintiff rested his case the court granted the defendant’s motion for nonsuit, and for this reason a statement of the material facts is essential to a presentation of the appellant’s exceptions.
The death occurred in the town of Southport, Brunswick County, in an alley the outlet of which is on West Street. At the northwest corner of the intersection of West and Horne streets there is a store which was occupied by C. J.…
