An order of transfer was made in these cases in order that we might give further consideration to the two questions which formed the basis of the opinion of the District Court of Appeal. The first of these questions was whether the state under the Bovine Tuberculosis Law (Stats. 1931, p. 2392) of the state is liable for animals which did not react to the tuberculin test, killed under the direction of its regularly and lawfully appointed officers.
