This appeal follows on the heels of a summary judgment favoring defendant-ap-pellee Worcester Insurance Company (Worcester). Carlton v. Worcester Ins. Co., 744 F.Supp. 395 (D.R.I.1990). Summary judgment is, of course, permissible only when “there is no genuine issue as to any material fact and ... the moving party is entitled to a judgment as a matter of law.” Fed.R.Civ.P. 56(c).
