MEMORANDUM OPINION

TOM S. LEE, District Judge.

This cause is before the court on the motion of the plaintiff for partial summary judgment and the cross-motion of the defendants for summary judgment. By order of April 17, 1987, this court denied the parties’ motions. Following a conference with counsel and a clarification of the parties’ respective positions regarding certain factual issues, the court at the parties’ request agreed to reconsider the motions.
