is an appeal by plaintiff from a judgment in favor of defendants, and also from a judgment in favor of defendant Westover upon an original and also upon an amended and supplemental counterclaim. Neither the testimony taken in the court below nor on the motion for a new trial is before us.

Plaintiff brought this action against the defendants, Myron Westover, W. H. Houghton, Frank H.
