Appeal from the District Court, First Judicial District, Los Angeles County. The Court below rendered judgment against the defendants Pierre and Jean Louis Sansevain, and Requena, the executor, but gave judgment in favor of defendant Rene. The defendants against whom judgment was rendered appealed. The other facts are stated in the opinion of the Court.

Jean Louis Vignes, a citizen of France, came to California about the year 1827, and settled at Los Angeles, where he resided till his death, in January, 1862. He left in France a wife and four children, Marie, Elizabeth, Jeanne, and Jean. The wife of Vignes died in France about the year 1843, having never been in this country. Said Vignes, at the time of the death of his wife, owned a tract of land in Los Angeles, *380called “ Aliso,” which he purchased during his residence in that place.
