WEISBERGER, Justice.

This case comes before us on appeals from both parties from orders entered by a justice of the Superior Court during the trial of an action on book account filed by the plaintiff and a counterclaim filed by the defendants. The trial justice dismissed the plaintiffs complaint without prejudice for lack of capacity to sue pursuant to the provisions of G.L.1956 (1985 Reenactment) § 7-1.1-117. The trial justice directed a verdict against the defendants on their counterclaim and rendered judgment accordingly. We vacate the judgment and remand for a new trial. The facts…
