The plaintiff bank, which the trial court justifiably concluded is the only plaintiff having any present interest in the appeal and is hereinafter referred to as the plaintiff, is the owner of Shore Island located in Long Island Sound at Byram in Greenwich. On this island there are five dwelling houses, one of which has in the past been used as a boarding house, one hundred bath houses, six -cabanas and several pump houses.
