Defendants have moved for summary judgment on plaintiffs claim under the Fair Labor Standards Act (FLSA), as well as on plaintiffs two supplemental state law claims. Docket Item [“D.I.”] 62. In the first count of his amended complaint, plaintiff alleges retaliatory discharge under the FLSA. D.I. 16 at ¶¶ 17, 19 citing 29 U.S.C. § 215(a)(3) (1988). In his second and third counts, he alleges breach of an implied covenant of good faith and fair dealing under Delaware law. D.I. 16 at ¶¶ 25, 31.
