KAUFMAN, Senior District Judge.(1) On May 17, 1995, plaintiff, (“Cross”) filed a complaint alleging that his former employer, 1 Bally’s Health and Tennis Corporation (“Bally’s”), discriminated against him in violation of 42 U.S.C. § 1981 and § 1981(a) (“Section 1981”) by treating him differently on the basis of race, and retaliated against him for complaining about violations of Title VII of the CM Rights Act of 1964, 42 U.S.C. § 2000e (“Title VII”), the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 201 et seq. and the Maryland Wage and Hour Law, Md.
