This case concerns a claim that a United States probation officer negligently failed to record or deliver a deed of trust. First National Bank in Brookings (the Bank) sued under the Federal Tort Claims Act (FTCA), 28 U.S.C. §§ 2671-2680, to recover a loss it attributes to the alleged negligence. The district court 1 granted the government’s motion for summary judgment, ruling that the Bank’s claim was barred by the two-year statute of limitations in 28 U.S.C. § 2401(b).
