This is an action of mandamus, brought originally in this court by the Columbus Water-works Company against the city of Columbus and its officers and others, *667to compel the defendants to levy and collect certain taxes, especially a tax sufficient to raise the sum of $3,000, with which to pay for the use of 50 hydrants for the year 1891. The facts supposed to be involved in the decision of this controversy have been largely agreed upon by the parties, and evidence has also been introduced.
