After a jury trial, Michael Backey appeals from his conviction for incest, contending: (1) that the evidence was insufficient to support the verdict; (2) that the trial court erred in denying his motion to suppress certain incriminating statements made by him; (3) that he received ineffective assistance of counsel; (4) that the trial court erred by denying his request to be present at the hearing on his motion for new trial; and (5) that the trial court failed to affirmatively instruct him on his rights to testify or not at his trial.
