This action of trespass for false imprisonment was brought against the defendant, a police officer, for the false arrest of the plaintiff on the charge of violating the provisions of a statute subsequently declared to be unconstitutional. The case was tried before a superior court justice sitting without a jury and resulted in a decision for the defendant. The case is before us solely on the plaintiff’s exception to> such decision.
