On September 30, 2005, the Court certified a class for the settlement of securities fraud claims arising out of the merger of America Online, Inc. (“AOL”) and Time Warner, Inc. (“Time Warner”) into AOL Time Warner, Inc. (“AOLTW”). 1 Following certification, a number of parties opted out of the class and filed individual actions throughout the country. Those actions were transferred to this Court by the Judicial Panel on Multidistrict Litigation (the “JPML”).
