The following certified question has been presented to the Supreme Court by the Honorable Court of Civil Appeals for the Fifth District.

H. W. Evans, as plaintiff, filed suit in a district court of Dallas County against American Publishing Company, a private corporation, with its principal place of business in Travis County, and M. M.
