McCarthy v. Allstate Insurance

Plaintiff, Daniel F. McCarthy, appeals from an order entered by the circuit court of Cook County granting defendant Allstate Insurance Company’s amended motion to strike and dismiss plaintiff’s second amended complaint. The sole issue presented for review is whether the trial court erred in dismissing plaintiff’s second amended complaint.

For the reasons hereinafter set forth, we reverse and remand the cause for proceedings not inconsistent with this opinion.
