DESMOND, P. J.—

In a jury-waived trial appellant was convicted of violating section 337a, subdivision 2, of the Penal Code, which prohibits the keeping or occupancy of premises “for any period of time whatsoever” with a book or books, paper or papers, apparatus, device or paraphernalia for the purpose of recording or registering bets upon the result of horse races and other contests.
