TIREY, Justice.
This is an appeal from the order of the Court of Domestic Relations No. 3 of Harris County, Texas, granting defendants’ motion for summary judgment. Plaintiff went to trial on her original petition which was filed January 3, 1962. Pertinent to this discussion she alleged that on the 1st day of July, 1960, she filed a petition in Cause No. 552,474 in the same court against Arnold J. Jett, asking for an annulment of her marriage to him; that on the same day such court entered a decree purporting to annul the marriage of plaintiff and Jett, which decree is recorded in Vol. 28 of…
