This action was instituted in the district court of Pottawatomie county on the 30th day of August, 1930, by the plaintiff in error, Walker Hembree, against the defendants in error H. T. Douglas and H. F. Potts. Since the parties occupy the same position in this court as they occupied in the trial court, they will be referred to as plaintiff and defendants, respectively.
