CLARK, Associate Justice.
This is an appeal from a judgment and sentence based upon a jury verdict finding the defendant guilty of the crime of embezzlement. The indictment contained 69 counts, 23 under each of three crimes charged, embezzlement, false pretense, 2 and larceny after trust. 3 At-the conclusion of the Government’s case the counts relating to false pretenses and larceny after trust were stricken.
