Plaintiff filed suit against defendant H. B. Deal Construction Co. (hereinafter referred to as defendant), who then filed a Third Party Petition against D. F. Edwards Heating Co. (hereinafter referred to as Edwards). Plaintiff did not amend its petition to seek judgment against Edwards. Defendant also filed a counterclaim against plaintiff for some moneys allegedly due under the contract.
