OPINION

FIRESTONE, Judge.

This ease involves a dispute over the discharge of, and disability rating conferred upon, a former Lieutenant Colonel in the United States Army Reserve. Currently pending before the court are the defendant’s March 15, 2011 Motion to Dismiss, or in the alternative, for Judgment upon the Administrative Record, and the plaintiffs May 3, 2011 Cross-Motion for Judgment upon the Administrative Record.
