Because I conclude that there was evidence tending to show that the plaintiff was not contributorily negligent, I must respectfully dissent. The plaintiff in this case put forth evidence to show that he was doing only what a reasonable, prudent house mover would do under like circumstances. There was evidence to show that the plaintiff was using insulated tools to attempt to remove the power line, which was stuck on the house. There was testimony from an engineer tending to show that the plaintiff was using proper tools and was proceeding in what could be considered a reasonably safe manner.
