Larsen Lanier brought suit on January 26, 1940, against Gibraltar Fire and Marine Insurance Company to recover $350 under a fire insurance policy, a copy of which policy, issued on December 14,1938, was attached to the petition. It was alleged in the petition as amended that on January 10, 1939, the plaintiff’s insured stock of goods was totally destroyed by fire; that on January 20, 1939, the company was notified and furnished with proof of loss, which was received by it on January 23, 1939, but that the company failed and refused to pay the plaintiff according to the terms of the insurance…
