This action was brought to recover damages alleged to have been suffered by plaintiffs by reason of the alleged failure of the defendant to comply with the terms of a contract entered into by it with plaintiffs. Plaintiffs had judgment for $6,397.50, and defendant appealed from the judgment and from am order denying its motion for a new trial. The appeal from the judgment has heretofore been dismissed for the reason that it was not taken within six months after the entry of the judgment.
