Matthew J. Hart sued FCI Lender Services, Inc. (“FCI”), his mortgage loan servicer and a debt collector, seeking damages under the Fair Debt Collection Practices Act (“FDCPA” or the “Act”), 15 U.S.C. § 1692 et seq., on behalf of himself and others similarly situated. Hart asserts. that FCI violated the Act by sending him two written communications that failed to comply with FDCPA requirements that debt collectors timely provide certain notices to debtors.
