OPINION

JACKSON, Judge:

In May of 1986, LaMar Stevenson, having been delinquent on several premiums due on a life insurance policy with Chubb Life American, was cancelled by Chubb. Stevenson then sought new life insurance coverage on himself through Roger Fleiss, an insurance salesman, and Talbert Corporation, 1 Fleiss’s employer at all times rele vant to this case. Talbert Corporation and Fleiss recommended to Stevenson that he seek life insurance through First Colony Life Insurance Company.

Stevenson filled out and signed an application provided by Talbert Corporation through Fleiss for life…
