— To an understanding of the controversy involved in this proceeding, it is necessary to set forth the facts with some minuteness of detail. On November 12, 1919, one J. F. Van Hoof was the owner of certain real property, situated in the city of Seattle. There was upon the property at that time a building of some hind, which the owner desired to remodel into an apartment house. On that day he borrowed from the Universal Savings & Loan Association the sum of $8,000, which he agreed to repay in sixty monthly instalments of $170 each.
