MEMORANDUM OPINION AND ORDER

PALLMEYER, District Judge.

Plaintiff Michael Milano brought this action pursuant to the Federal Tort Claims Act, 28 U.S.C. §§ 2671-2680 after injuring his back in a 1995 collision with a United States Postal Service vehicle. Following two unsuccessM surgeries, Plaintiff claims he is unable to return to work as a truck driver. In an administrative claim, Milano claimed $500,000 in damages; in this lawsuit, he seeks recovery in excess of $4 million.
