RAYMOND J. BRODERICK, District Judge.

Defendants Guido Frezzo, James L. Frezzo, and Frezzo Brothers, Inc. (hereinafter “Frezzo Brothers”) have petitioned this Court pursuant to 28 U.S.C. § 2255 to vacate and set aside their sentences pursuant to their convictions for discharging pollutants into navigable waters without a permit. 1

The defendants were found guilty by a jury on all six counts of an indictment charging them with willfully or negligently discharging pollutants into navigable waters in violation of Sections 301(a) and 309(c) of the Federal Water Pollution Con trol Act as…
