OPINION AND ORDER

LOWE, District Judge.

Before the court is the-motion of petitioner Jesus Tineo (“Petitioner” or “Tineo”), pursuant to 28 U.S.C. § 2255 (“Section 2255”), to vacate, set aside or correct his sentence. For the reasons stated below, the Court denies Petitioner’s motion.

BACKGROUND

On June 4, 1990, Petitioner pleaded guilty to charges of conspiracy to knowingly possess cocaine base (“crack”) with the intent to distribute it in violation of 21 U.S.C. §§ 812, 841 and 846 (“Count I”) and possession with intent to distribute crack in violation of 21 U.S.C. §§ 812 and 841 (“Count II”).…
