WELLFORD, Circuit Judge.

Defendant, Daniel H. Overmyer, appeals his conviction in the United States District Court for the Northern District of Ohio on one count of filing a false proof of claim in bankruptcy in violation of 18 U.S.C. § 152, ¶ 4. Defendant challenges his conviction on two grounds. First, defendant submits that the conviction must be vacated and the indictment dismissed in light of Kastigar v.
