Becicer, J.:

Respondent Kitrich Powell filed a petition for a writ of habeas corpus challenging his first-degree murder conviction and death sentence. The district court denied the petition for the most part, a decision which we affirmed in an earlier appeal. However, the district court also eventually determined that Powell’s trial counsel were ineffective in failing to call Powell’s brothers to testify at the penalty phase of his trial.
