The plaintiff in error was defendant below, and the defendant in error was the plaintiff. The parties will be, designated herein as plaintiff and defendant, as they appeared in the trial court.

The plaintiff brought suit against the defendant for loss and damage occasioned by a fire which destroyed property covered by a' fire policy alleged to have been issued by defendant. The policy relied upon was for $2,800. and the goods and property destroyed were of the alleged value of $5,143.37, arid plaintiff seeks to recover the full amount of the policy. Among other…
