The appeal in this case is prosecuted on behalf of the People of the state of California from a judgment of the trial court based upon its order sustaining the defendant’s demurrer to the amended information without leave to amend. The defendant was prosecuted under the provisions of an act of the legislature adopted in 1929 (Stats. 1929, p. 665) relating to the purchase and handling of deciduous fruit, including grapes and dates, produced by another in the state of California.
