MARTIN, Judge.

Assigning error to the dismissal of his petition for judicial review, petitioner contends that the amendment to the zoning ordinance, regulating marina development, was void ab initio because the Town of Bath violated procedural rules and substantive due process in amending the zoning ordinance. In the alternative, the petitioner contends that the trial court erred by not granting him, before it ruled on the motion to dismiss, an opportunity to respond to affidavits submitted by the Town of Bath in support of the motion.
