The defendant stands indicted for perjury, as defined by Rev. St. U. S. § 5392, upon an examination before Pension Examiner W. M. Ragsdale, had on the 14th day of November, 1895, at his office, in the city of Memphis. On the trial the defendant excepted to the introduction of the written, examination, as taken down by the examiner, upon the ground, among others, that the said examination was a violation of his privilege to remain silent upon the matters inquired about, as secured by the fifth amendment to the constitution of the United States, which objection was reserved by the court, and,…

(after stating the foregoing facts). In support of the direction which has just been given for the acquittal of the defendant, the court feels that it is incumbent upon it to express the considerations which have led it to that conclusion, being fully impressed with the importance of the rulings that are now made in relation to the administration of the pension bureau for the protection against peculation of the vast sums annually appropriated for pensions.
