The defendant is a 69-year-old man who has never been arrested before. He is charged by misdemeanor complaint with the crimes of sexual abuse in the second degree (Penal Law § 130.60), and unlawful imprisonment in the second *624degree (Penal Law § 135.05), solely on the basis of the allegations of an 11-year-old child. He moves for the dismissal of the accusatory instrument on two grounds.
