Before the Court is a Report and Recommendation (the “Report”) of United States Magistrate Judge Andrew J. Peck dated September 29, 1997, recommending that the Court deny plaintiffs motion to strike defendant Kamino International Transport’s (“Kamino”) defense of limited liability and grant Kamino’s cross-motion to limit its liability to $50 per package.
