The defendants appealed from a judgment entered in favor of the plaintiff in an action to recover damages for personal injuries.
The Butte Electric Railway Company maintains a double-track system between the city of Butte and Columbia Gardens, over which it operates street-cars propelled by electricity. The cars from the city to the Gardens use the south track, and the cars returning from the Gardens to the city use the north track.
