This is an action of contract on a sealed instrument. A verdict was directed in favor of the defendant. Therefore the case must be considered on that aspect of the evidence most favorable to the plaintiff. If the case had been submitted to the jury, they might have believed only the evidence helpful to the plaintiff and disregarded all adverse testimony by which the plaintiff was not bound as matter of law.
