The plaintiff’s case is founded on his claim as orginally presented to the defendant, that he had “information of value in the operation of the defendant’s road” which he offered to communicate for a valuable consideration. It was agreed that if he would communicate the information to the defendant and the defendant usedit, the plaintiff should receive five per cent of the receipts derived from such use.
