D’Andre Bannister timely appeals his convictions for second degree murder, aggravated child abuse, and kidnapping a person under thirteen years of age. This ease involves the substantial, and eventually fatal, injuries Bannister’s four-year-old stepson sustained while under Bannister’s exclusive supervision. At trial, Bannister contended that the victim’s injuries were the result of an unfortunate fall from a tall mango tree.
