MEMORANDUM DECISION AND ORDER

WINDER, District Judge.

This matter is before the court on cross-motions by plaintiff Imperial Savings Association (“Imperial”) and defendant Stewart Title Company (“Stewart”) for partial summary judgment on the issue of whether there is a binding arbitration agreement between Imperial and Stewart. At a hearing on January 11, 1990 to consider Imperial’s motion for appointment of a receiver and the parties’ cross-motions for summary judgment, the parties agreed to submit the latter motions without oral argument.
