MEMORANDUM OPINION

This matter is before the court on the following motions of the defendant, Diageo Americas Supply, Inc. (“Diageo”):(1) Motion to dismiss Plaintiffs’ First Amended Class Action Complaint pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim (DN 18); and(2) Motion for leave to file supplemental authority (DN 28).
