This case presents an appeal from the district court of Muskogee county. It was instituted by J. T. Odom against the Singer Sewing Machine Company to recover damages for an injury suffered by Odom in the course of his employment, and the parties will be referred to as they appear in the lower court. There is little conflict in the testimony as to the material facts. The plaintiff, Odom, was employed by the defendant at its Muskogee office, as a collector and salesman.
