This appeal presents for review the proposition ns to whether or not the trial court erred in granting a now trial after permitting the plaintiff in the trial court to file a supplemental verified motion for new trial on the grounds of newly discovered evidence after a trial of the issue of facts. The original motion for new trial was filed within the statutory time. Verdict was for defendant.in the trial court.
